The Short Version (Plain English)
- You own your content. Every article, outline, or draft generated through Cluster Writer belongs to you. I claim zero rights over it.
- AI credits are consumed instantly. When you hit "Generate," the system fires API calls to language models (OpenAI, Google Gemini, or similar). Those calls cost money the moment they execute. That's why refunds after credit usage aren't possible — the cost has already left the building.
- Don't use this tool to produce spam or illegal content. Generating thousands of doorway pages, publishing medically dangerous misinformation, or scraping copyrighted material violates these terms and will result in account termination.
- I can update these terms. If something material changes, you'll get an email at least 14 days before the new terms take effect.
1. Acceptance of Terms
By creating an account or using any part of the Cluster Writer platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Cluster Writer is an AI-powered content creation platform that automates the research, outlining, writing, and publishing of SEO-optimized articles. The Service relies on third-party large language model APIs (including but not limited to OpenAI and Google Gemini) to generate text content.
3. Account Registration
You must provide accurate, current information during registration. You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility.
4. AI-Generated Content & Intellectual Property
4.1 Ownership
All content generated through the Service using your account and your inputs is your property. I do not claim authorship, copyright, or any intellectual property rights over your generated output.
4.2 Your Responsibility
You are solely responsible for reviewing, editing, and fact-checking all AI-generated content before publication. AI models can produce inaccurate, misleading, or biased text. Publishing AI output without human review is done at your own risk.
4.3 Input Data
Any prompts, keywords, outlines, or custom instructions you provide remain your intellectual property. These inputs are processed through third-party AI APIs exclusively to generate your requested content. I do not use your inputs to train proprietary models.
5. Prohibited Uses
You agree NOT to use the Service to:
- Generate bulk spam content designed solely to manipulate search engine rankings with no value to readers.
- Produce content that is illegal, defamatory, threatening, or promotes violence in any jurisdiction.
- Create content that impersonates real individuals or organizations without authorization.
- Generate medical, legal, or financial advice intended to replace licensed professional guidance.
- Reverse-engineer, decompile, or attempt to extract the source code or proprietary prompts of the Service.
- Resell access to the Service or sub-license your account to third parties without written permission.
Zero Tolerance Policy
Violation of these prohibitions may result in immediate account suspension or termination without refund.
6. Payment, Credits & Refund Policy
6.1 Credit-Based System
The Service operates on a prepaid credit system. Credits are consumed each time the platform sends API requests to language model providers on your behalf.
6.2 No Refunds After Usage
Because API costs are incurred immediately and irreversibly upon each generation request, refunds are not available for credits that have been consumed. Unused credit balances may be refunded within 14 days of purchase upon request, provided no generation requests have been made.
6.3 Pricing Changes
I reserve the right to adjust pricing. Existing prepaid credits will be honored at their original value regardless of future price changes.
7. Service Availability & Limitations
The Service is provided on an "as is" and "as available" basis. I do not guarantee:
- Uninterrupted or error-free operation.
- That generated content will rank on any search engine.
- That third-party API providers (OpenAI, Google, etc.) will maintain consistent availability, pricing, or output quality.
8. Limitation of Liability
To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, loss of revenue, data, or business opportunities.
Total liability for any claim related to the Service shall not exceed the amount you paid for credits in the 12 months preceding the claim.
9. Termination
9.1 By You
You may close your account at any time. Unused credits are forfeitable upon voluntary account closure unless a refund is requested within the eligibility window.
9.2 By Me
I reserve the right to suspend or terminate your account immediately if you violate these Terms. In cases of termination for cause, no refund will be issued.
10. Modifications to Terms
I may update these Terms from time to time. Material changes will be communicated via the email address associated with your account at least 14 days before they take effect.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law principles.
